Employment-based immigration covers two different goals: a temporary work visa that lets you live and work in the United States now, and an employment-based green card that gives you permanent residence. The right route depends on your achievements, your education, whether you have a U.S. employer, and whether you are investing in a business of your own.
The Law Offices of Anna Danielian, based in Burbank, works with clients from Glendale, Burbank, and throughout Los Angeles County to choose the strongest category and build a complete, well-documented filing from the start.
A temporary work visa for people with extraordinary ability in the sciences, education, business, or athletics (O-1A), or in the arts and film and television (O-1B). It is filed by a U.S. employer or agent and is approved for up to three years at first, with one-year extensions after that.
A green card for individuals with extraordinary ability who have sustained national or international acclaim. You can file for yourself: no employer sponsor and no labor certification are required.
For professionals with an advanced degree, or a bachelor's degree plus five years of progressive experience, and for people of exceptional ability. It usually requires a job offer and labor certification; a National Interest Waiver removes both requirements.
A renewable temporary visa for nationals of treaty countries who make a substantial investment in a real, operating U.S. business and direct it themselves. The business must be more than marginal.

Not always. EB-1A (extraordinary ability) and EB-2 with a National Interest Waiver allow you to petition for yourself, without an employer sponsor or a labor certification. Most other employment-based categories require a U.S. employer and, in many cases, an approved PERM labor certification.
The O-1 is a temporary work visa sponsored by a U.S. employer or agent. EB-1A is a permanent green card category that you can file for yourself. The evidence overlaps, so many clients start on an O-1 and later file for EB-1A.
Not by itself. The E-2 is a renewable temporary visa for nationals of treaty countries who invest in and run a U.S. business. A green card requires a separate basis, such as an employment-based or family-based petition.
